Upon installation of the Application, ParkSocially collects information about the use of the Services from the mobile device on which ParkSocially is installed and utilized. This includes but is not limited to the following:
Information ParkSocially collects about users from third parties
ParkSocially may receive non-personally identifiable, aggregated analysis and other information from third-party services for better understanding of the ways in which users interact with the Application and website. In addition, ParkSocially may receive information from third-party services about how ParkSocially's marketing efforts perform on third-party websites or other platforms.
ParkSocially utilizes various technologies for information storage and collection, including but not limited to cookies, local storage, browser web storage, application data caches, databases, and server logs.

Personal information shared by users
Users share personal information with ParkSocially, including but not limited to name; automobile make, color, model, and year; photographs or images uploaded to profiles; location information; and other information and files. This information may be shared either directly with ParkSocially for the purpose of providing the Services and/or to relevant users in cases when a parking spot is requested or shared through the Application. User information may also be shared through third-party services and platforms which interact with the Services should the users choose such.
Instances in which ParkSocially shares user information
ParkSocially does not sell, rent, or lease users' personal information to third parties, nor will it share users' personal information with exception of the following purposes, in which case such information will be shared with the appropriate law enforcement agencies:
Controlling users' personal information
Users may control and keep their personal information current by completing the fields in their profile. Inputting false or incorrect information may prevent the user from registering for an account with ParkSocially and impair the Company's ability to provide the Services.
Deleting Accounts and Personally Identifiable Information
Users may delete or deactivate their accounts directly through the application by selecting the appropriate option on the Delete Accounts screen. ParkSocially will automatically store all user information for a period of thirty (30) days following a user's deletion of their account. After the thirty-day period, the information and data will no longer be accessible to the user. ParkSocially may continue to store user information and data for analytics purposes beyond the thirty-day period in order to optimize the Services and improve the product and user experience. Any unplanned or routine maintenance, outages, bugs, or failures in the operation of the Application or website may cause delays in the time frames defined in this policy.
How ParkSocially retains collected data
Some data may be deleted at any time, some data is deleted automatically, and some data will be retained by ParkSocially for longer periods of time when necessary. This section describes why we hold onto different types of data for different periods of time.
How ParkSocially uses aggregated information
In order to properly operate the Services and/or enhance user experience, ParkSocially may use anonymous, statistical or aggregated information in a way that does not enable the identification of any specific user. Aggregate information may also be used to create new features or services.
The ParkSocially Services and experience have been designed and executed with security features that protect users' information. ParkSocially makes every effort to minimize risk of theft, damage, loss, unauthorized access, or misuse of user or other information. ParkSocially employees, contractors, partners, are also subject to strict confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations. However, although ParkSocially makes all reasonable efforts to protect users' information, ParkSocially cannot guarantee that the Company's databases will be completely protected from any wrongdoings, malfunctions, unlawful or unauthorized access, or other kinds of abuse and/or misuse.
Compliance & cooperation with regulators
User data is stores on servers located around the world. As such, user information may be processed on servers located outside the individual user's country of residence. However, regardless of the location of storage of user data, ParkSocially applies the same protections for all data as described in this policy.
In the case of receiving a complaint, ParkSocially responds by directly contacting the user, person, or entity who made the complaint and works with the appropriate regulatory of law enforcement authorities when necessary to resolve any issues or problems.
Contacting ParkSocially regarding privacy concerns reports
By continuing to use the Services, users indicate their acceptance of the amended terms.
ParkSocially creates a history of user location and route information made when using the Service. ParkSocially uses this history to provide the Service to users and to improve the quality and accuracy of the Service. ParkSocially requires each individual user to create an account attached to the mobile phone number that will be used to access the Service. ParkSocially will attach and associate all information for that individual user with that account.
The Service uses both proprietary and third-party Software for map displays, updating and maintaining road and on-street parking spot information, and other aspects and features of the Service. Users are not authorized to redistribute any of the software without the written permission of ParkSocially or the relevant third-party creator and/or vendor.
The Service is intended for use by users who are or over the age of eighteen (18) years. Accounts belonging to users under the age of 18 will be canceled and deleted by ParkSocially, upon receiving notice.
WHAT IS THE SERVICE
The Service is a platform built for our Community of users in New York City, its environs, and other metropolitan areas to share on-street parking spots in real time near their desired destination. The Service is provided mainly through the Application.
ParkSocially hereby grants its users a non-exclusive, time-limited, non-transferable, non-sub-licensable, revocable license to use the Service (including the Software) for non-commercial purposes, subject to these Terms
USING THE SERVICE
Users may use the Service for the sole purpose of searching for, finding, and offering on-street parking spots. Users may not use the Service commercially without the express written permission of ParkSocially. Users may not copy, print, save, or otherwise use data from the Company's website or the Service's database. This clause does not limit the use of the database as intended by the Software and for the purposes of private and personal use of the Service
When using the Service or the site, users may not engage in scraping, data mining or aggregating, harvesting, screen scraping, and/or indexing. In using the Services, users agree not to use any robot, spider, scraper, or other automated or non-automated method to access the Company's website or the Service's databases for any purpose without the express prior written permission of ParkSocially.
The Software may not be used in any way that is not expressly permitted by these Terms.
Failure to comply with the provisions set forth below may result (at ParkSocially's sole discretion) in the termination of access to the Service. Such failure may also expose users to civil and/or criminal liability
Users of the Services may not:
(i) copy, adapt, modify, decompile, translate, reverse engineer, or disassemble any portion of the content included in the Service and/or Company website, or in any way or publicly display or distribute it;
(ii) make any use of any of ParkSocially's content on any other website or networked computer environment for any purpose, or replicate or copy the content without ParkSocially's express prior written consent;
(iii) create any browser or border environment around the content;
(iv) interfere with or violate any third party or other user's right to privacy or other rights, including copyrights and any other intellectual property rights of others, or harvest or collect personal information about visitors or users of the Service and/or Site without their express consent, including using any robot, spider, site search or retrieval application, or other manual or automatic device or process to retrieve, index, or data-mine;
(v) abuse, harass, threaten, or otherwise violate the legal rights of other users of the Service, including copyrights and/or other intellectual property rights either through the Service or in person;
(vi) transmit to or in connection with the Service and/or Company website any virus, worm, Trojan Horse, time bomb, web bug, spyware, or any other computer code, file, or program that may or is intended to damage, hinder, or interfere with the operation of any hardware, software, or telecommunications equipment;
(vii) interfere with or disrupt the operation of the Service and/or Site, or the servers or networks that host the Service and/or Company website or make the Service and/or website available, or disobey any requirements, procedures, policies, or regulations of such servers or networks;
(viii) sell, license, or exploit for any commercial purposes any use of or access to the Content and/or the Service and/or website;
(ix) frame or mirror any part of the Service and/or Company website without ParkSocially's prior express written authorization;
(x) create any database or other collection of information database by collecting and storing any or all of the content from the Service and/or Company website;
(xi) forward or pass to other individuals or entities any data generated from the Service and/or Company website without the prior written consent of ParkSocially;
(xii) transfer or assign use of password(s) associated with the account, even temporarily, to a third party;
(xiii) use the Service and/or Company website for any illegal or other unauthorized purpose;
(xiv) use the Service, Company website or other content for non-personal or commercial purposes without ParkSocially's express prior written consent;
(xv) use the Service for any purpose other than searching for, finding, or sharing or offering parking spots;
xvi) infringe or violate any of these Terms.
The ParkSocially Community (the "Community") is made up of all users of the ParkSocially Service. All Community members must abide by the following ParkSocially Community Rules (the "Rules"). Failure to abide by the Rules may result in the termination of user account and/or rights to use the Service at ParkSocially's discretion.
TERMINATION OF USE OF THE SERVICE
Users may terminate their use of the Service at any time, for any reason, and are not obligated to advise ParkSocially of such.
ParkSocially retains the right to refuse any user access, at any time, to the Service for any reason ParkSocially deems appropriate, at its sole and absolute discretion.
All users of the Service may create and transmit information to other users through the App (hereafter "Information"). Information is separate and different from any and all third-party sponsored advertisements that may appear on the Service or the Company website at a future date. Individual users assume sole responsibility for any Information shared through the App or Company website. Each individual user is liable for the consequences of submitting and sharing such Information.
RIGHTS IN INFORMATION
Transmission of any and all Information through the App or Company website indicates the user's voluntary granting to ParkSocially and the users of the Service an irrevocable, perpetual, non-exclusive, royalty-free license to use, copy, distribute, prepare derivative works, and display in public the Information. The license is extends to both personal use and any commercial use of Information, at ParkSocially's sole and absolute discretion.
ADDITIONAL IN-SERVICE USES OF INFORMATION
ParkSocially will utilize Information user-submitted for identifying and tracking user parking locations, providing users with information about the relevant parking locations for their desired destinations, and for research purposes. ParkSocially may also use both personally identifiable and non-personally identifiable Information for the purposes of improving our Service and the user experience.
ParkSocially retains sole discretion in determining which and for how long Information will be utilized, the location of the Information, how and when it appears on the Service or Company website, its design and any other matter regarding publication of Information within the Service. The publishing and/or transmission of Information submitted by users through the Service does not guarantee its validity, accuracy, or legality.
COPYRIGHT, TRADEMARKS, AND PATENTS
All intellectual property rights in and to the Service, Company website, and Company database, including copyrights, trademarks, industrial designs, patents and trade secrets are either the exclusive property of ParkSocially or its affiliates, or are exclusively licensed to ParkSocially. The Service and website are protected, among others, by United States Copyright law, as well as by applicable copyright provisions as set forth by law in the United States and elsewhere.
ParkSocially, the ParkSocially logo, and other trade and/or service marks are the sole property of ParkSocially or its affiliates. Users may not use such marks for purposes that are not expressly authorized in these Terms without the prior written permission of ParkSocially.
The design of the maps presented and used within the Service and Company website are protected works under applicable copyright laws. ParkSocially and its affiliates retain all intellectual property rights in them. The license granted to users of the Service in these Terms does not include a license to use the maps or any of the marks indicated in the previous paragraph or notation embedded in the maps that are displayed on the Application. Users may not copy, print, or otherwise duplicate or reproduce more than one copy of material appearing on the website.
ParkSocially may protect the Service by utilizing technologies intended to prevent or block unauthorized use of the Service. Any infringement or attempted infringement of this provision will result in the termination of all rights outlined under these Terms. Users who circumvent any of the means taken by ParkSocially to protect the Service from unauthorized use must immediately cease any and all use of the Service.
By utilizing the Service on an Apple device, users agree and acknowledge that:
Each user must warrant that: (i) they are not located in a country that is subject to any U.S. Government embargo, or one that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) they are not included within any U.S. Government list of prohibited or restricted parties.
LIMITATION OF LIABILITY AND WARRANTY
PARKSOCIALLY PROVIDES THE SERVICE AND CONTENT INCLUDED THEREIN FOR USE ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND SUCH SERVICE AND CONTENT CANNOT BE CUSTOMIZED FOR EACH AND EVERY USER.
In addition, ParkSocially disclaims any warranties relating map and location accuracy, Information, navigation routes and directions, available on-street parking spots, or any other Information presented or displayed in or by the Service.
Users agree and acknowledge that they will assume sole responsibility for the use of the Service. Users also agree that their use of or reliance on the Service is made entirely at their own risk. Furthermore, users agree and acknowledge that it is their sole responsibility to abide by and comply with all applicable laws while using the Service
BREACH AND INDEMNITY
Users agree to indemnify and hold harmless ParkSocially and its employees, officers, directors, and agents, as well as all third party advertisers of Ads and Rewards Partners from and against all damages, claims, expenses, and liabilities that arise as a result of user violation of these Terms. This is intended to cover all expenses, payments, loss, and/or any other damage, whether it be direct or indirect or monetary or non-monetary, incurred by ParkSocially, its employees, officers, directors or agents as a result of user's violation of the Terms
ParkSocially respects the privacy of its users throughout the duration of their use of the Service.
MODIFICATIONS TO THE SERVICE AND SOFTWARE
ParkSocially may, either partially or in its entirety and without being obligated to provide any advance notice, modify, adapt, or otherwise change the Application, the Service's features, the user interface and design, the extent and availability of the contents and information stored and used within the Service and any other aspect related to the Service. Users will have no claim, demand, or complaint against ParkSocially for applying such changes or modifications or for any and all failures incidental to such changes or modifications.
TERMINATION OF SERVICE
ParkSocially may, at its sole discretion and by its own judgment, at any time, terminate the provision of the Service in its entirety or any part thereof, either temporarily or permanentl. In the event that ParkSocially terminates its service either in its entirety or for an individual user, ParkSocially shall not be required to reimburse or refund any payments made to ParkSocially prior to such termination.
MODIFICATIONS OF THESE TERMS
On occasion, ParkSocially may modify these Terms. Should substantial, significant, and/or fundamental changes are introduced, a notification will be sent to all users in the updated version of the Application as well as on the Company website. Continued use of the Service after the Terms have been modified demonstrates assent and agreement to abde by the updated Terms. Should a user dissent to updates to the Terms, they must discontinue all use of the Service and Company website.
GOVERNING LAW AND JURISDICTION
These Terms, the Software and the Service will be governed solely by the laws of the State of New York, United States or America, without giving effect to any conflicts of law principles. Any dispute, claim or controversy arising out of, connected with or relating to these Terms, the Software, and the Service will be under the exclusive jurisdiction of the competent court in New York, NY, USA.
Should a user wish to file any cause of action against ParkSocially arising out of or related to the ParkSocially Software or Service, the user must do so within a time period of one hundred and eighty (180) days from the day the user first becomes aware of the cause of action. Any failure to file a lawsuit within this time frame will result in the permanent barring of the cause of action. It will constitute the user's complete waiving of the lawsuit.
ASSIGNMENT OF RIGHTS
Users are not authorized to assign or transfer rights in connection with Service without the prior written consent of ParkSocially. ParkSocially may assign its rights in and to the Service to any third party at its sole and absolute discretion, provided that the third party undertakes ParkSocially's obligations to users set forth within these Terms.
NO LEGAL RELATIONSHIP
Users may contact ParkSocially at any time concerning any question about the Service through the channels listed on the "Help & Support" menu within the Application or through the "Contact Us" page on the Company website. ParkSocially will make our best efforts to address inquiries promptly.
